LIVA MISS DIVA WILDCARD – TERMS & CONDITIONS

Bennett, Coleman & Co. Limited (hereinafter referred to as “BCCL”) is a company within the provisions of the Companies Act, 2013, having its Registered Office at The Times of India Building, Dr. D.N. Road, Mumbai 400001. By participating in ‘LIVA Miss Diva 2021’ (hereinafter referred to as the ‘Pageant’), you accept and agree that you are of the minimum age of 18 and accept, agree and remain abide to the following terms and conditions:

• The Pageant is owned and organised by BCCL. ‘Miss Diva’ mark is registered trademark of BCCL.
• The Pageant shall be known as LIVA Miss Diva 2021.
• This Pageant is subject to BCCL’s policies and other conditions. You may contact BCCL to know more about the applicable additional terms and conditions.
• The duration of the Pageant is from July 2021 to October 2021.
• Wildcard winner will be declared on 31st August, 2021. The Wildcard Contestant shall be selected on the basis of decision of jury (as decided by BCCL) and voting in the ratio of 50:50.
• Wildcard voting timeline: Voting will go LIVE on LIVA's website on 24th August, 2021, 8:00am and end on 30th August 2021 11:59pm.
• BCCL reserves the right to change, alter or cancel this Pageant in part or full, or change any or all of the terms and conditions that are applicable, without giving prior intimation/notice of any kind and will not be liable for any consequential losses/damages. Decision of BCCL in this regard and in general with respect to this Pageant and the Terms & Conditions thereto shall be final, binding and non-contestable.
• Nothing contained herein amounts to a commitment or representation by BCCL to conduct further stages of Pageant or other schemes.
• Winners shall not conceal or misrepresent any information during the scrutiny or otherwise, failing which the participant shall be disqualified from participating in the Pageant and in the event the participant is declared winner of Wildcard entry scheme, the same shall be declared null and void and the next best participant (in terms of votes garnered) shall be declared winner.
• BCCL reserves the right to withdraw &/or alter any of the terms & conditions of this Wildcard entry contest at any time without prior notice.

Participants’ entering the Pageant shall be deemed as her acceptance of the following additional terms and conditions.

• The applicant must agree to abide by all rules, as changed from time to time by the Organizers. The Organizer(s) shall mean BCCL.
• The applicant should be between 18 to 27 years (as of 31st December 2021) & 5’4 & above in height.
• The applicant must produce the following age & nationality eligibility proof: Birth Certificate, Election Voters ID, Aadhaar Card or Passport.
• Miss Universe Organization also allows transwoman to participate in its events subject to fulfilment of their participation rules. In compliance to the said rules, Miss India Organization has also decided to allow transwoman to participate in Miss Diva Universe Pageant from 2021.
  The criteria stated by Miss Universe Organization and also followed by Miss India Organization is as follows: If the applicant’s gender or sex designated at birth was not a female, the applicant will have to provide a legal recognition of the assigned sex as female validly issued certificate in accordance to applicable Indian law. The applicant further understands and agrees in the event she is selected to participate in Miss Universe pageant, her participation will be subject to recognition of such certificate issued under Indian law by the local authorities wherever Miss Universe pageant is organized. The applicant will not claim any damage/loss incurred by her directly or indirectly on account of failure to participate in Miss Universe pageant due to non-recognition of the certificate issued under applicable Indian law. The applicant will also have to produce the passport issued by the Indian government, demonstrating legal recognition of the assigned sex as female.
• The participant uses the prefix 'Miss' (or equivalent) before her name. The participant should not / have not been married or engaged & never been through any ceremony directly or indirectly, either valid or invalid, whether civil, religious or tribal which is recognized as a marriage ceremony in any part of the world & should never have had a marriage annulled or never given birth to a child; have never been pregnant nor been a parent.
• The participant should be a Bonafede Indian Citizen, holding a valid Indian passport & should be a resident of India as per the applicable laws of India. OCI Card Holders will have to produce the OCI Card before participating. NRIs are allowed to compete for runner-up position.
• The participant or the participant's immediate family should not be related to any person employed in ABSL, TIML, TIL, Bennett Coleman & Company Limited, or any other company of the Times Group, contest sponsors & their sub-contractors, or any of the judges as informed to the participant at any stage. In case of such a relation, the participant must disclose the same immediately.
• If the participant is under any commercial contract with any modelling agency at the time of appearing for the auditions, she should declare it on email before she auditions virtually for the LIVA Miss Diva 2021 pageant.
• The participant once shortlisted cannot be a part of any other commercial contract or pageant. If already under any contract, then she should declare the same to the organization before auditions.
• The Organizers are not responsible for any delays or non-receipt of applications on any account & for any reason whatsoever.
• The participant should not have been qualified for or taken part in any contest as a representative of any country other than India & if so they need to declare it to Miss India Organization before auditions.
• The participant will have to participate in a disciplined & diligent manner throughout as per schedule for auditions & screening.
• Any profile or material asked by the Organization stating the participant information should be shared with the Organization on an immediate basis.
• The Organizers are not responsible if the sponsors do not make good the prizes promised by them.
• The Organizers are not responsible for any loss or physical injury that occurs to the participant on account of their participation in the virtual event. The participant will participate at her own risk & can have no claim against BCCL or any other Times of India group company in any regard.
• Incorrect information will result in disqualification, whether discovered prior to, during or after participation.
• The decision of the judges is final in all cases & the participant cannot in any capacity question the same on any platform.
• The participant cannot disclose any information or record or discuss the screening process or judges’ comments with anyone.
• The participant cannot get in touch with any judge during the judging process.
• If any participant has personal connection with any judge the participant must declare it during the auditions to the contestant managers.
• Any screening / audition footage or results internally declared or confidential information given by the Organization cannot be shared by the participant with any social media / digital page or with any person related to such platforms.
• Only persons of good health, sound mind & having no medical history of any mental illness & having a good moral character can participate herein.
• The participant should not have any cases (criminal or civil) registered against her.
• The schedule of the virtual events & qualification rounds are subject to change at the discretion of the Organizer.
• The participant if selected as one of the finalists will have to sign the legal contract with the Organization. The contract must be submitted 24 hours from the time it is handed over to the participant.
• All the content especially the audition tasks produced on the MX TakaTak app by the participant cannot be cross-promoted on any other competing short video content application unless notified or consented by the Miss India Organization.
• By submitting the Videos on MX TakaTak & copy pasting the link on the form, the participant is understood to have used the rights free music available on the application & if any participant has failed to do so post submitting the form then the participant will have to account for suitable repercussions if any.
• The Organizers are not responsible for non-completion / non-occurrence of the virtual event.
• In the event of any dispute, the Organizers decisions are final & binding on the participant.
• The courts of Mumbai have the jurisdiction over all disputes.
